Introduction

The Broker acts solely as an intermediary between clients and yacht charter operators worldwide.

1. Scope of Service

1.1. The Broker does not own, operate or manage any yachts. All bookings are made directly between the client and the yacht charter company or operator.

1.2. The Broker’s role is strictly limited to:

      presenting available offers,

      providing guidance,

      assisting in the booking process.

1.3. The Broker accepts no responsibility for the yacht’s condition, quality, crew behavior, or performance of the charter company.


2. Liability Disclaimer

2.1. The Broker shall not be held liable for any injury, loss, damage, delay, dissatisfaction, cancellation, or change arising from:

      mechanical failure of the yacht,

      weather conditions,

      decisions of the captain or crew,

      actions or omissions of third-party providers.

2.2. The client acknowledges that yacht chartering involves inherent risks, including but not limited to navigation, sea conditions, weather, and the behavior of other guests or crew.

2.3. The Broker strongly recommends that the client:

      obtains appropriate travel insurance (including cancellation cover, personal injury, liability, and property damage),

      carefully reads and agrees to the charter contract provided by the charter company.


3. Contracts and Payments

3.1. All yacht charter contracts are made directly between the client and the charter company. The Broker is not a party to the final contract.

3.2. The client is responsible for all payments required by the charter company, including deposits, final balances, security deposits, and additional services.

3.3. The Broker may collect payments on behalf of the charter company if expressly agreed but accepts no liability for the financial operations of third parties.


4. Complaints & Claims

4.1. Any issues or complaints regarding the yacht, crew, itinerary, or service must be reported directly to the charter company.

4.2. The Broker may assist in communication but holds no responsibility for resolving disputes or compensating the client.


5. Limitation of Liability

5.1. In any event where liability is established, the Broker’s total liability shall be strictly limited to the commission fee received from the relevant booking.

5.2. The Broker shall not be held liable for any events caused by force majeure, including but not limited to: war, civil unrest, strikes, natural disasters, epidemics, port closures, or government actions.


6. Data Protection (GDPR Compliance)

6.1. SAILOVE LTD is committed to protecting your personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.
